Former Downing resident pleads not guilty on child pornography charge

MENOMONIE — A 23-year-old former Downing man has pleaded not guilty in Dunn County Circuit Court on one felony count of possessing child pornography.

Javan E. Kastberg was arraigned January 24.

Following a preliminary hearing January 2, Judge Phillip P. Todryk found probable cause in the case and scheduled an arraignment hearing.

Kastberg’s former address was county Highway Q in Downing, but the address was changed in court records to Ellsworth during the arraignment hearing.

According to the criminal complaint, a woman who said she was a roommate of Kastberg’s told investigators that she had used Kastberg’s cell phone in December because her phone’s batteries needed to be recharged.

The woman said she noticed several squares on the phone that looked like pictures of girls and believed one picture to be her niece.

Upon further investigation, the woman discovered a movie of a young girl on the cell phone who appeared to be about nine years of age and was behaving in a sexual manner.

The woman showed the video to her husband who agreed that girl looked like she was eight or nine years old and that the video appeared to be pornography.

The Dunn County Sheriff’s Department received a call on December 19 from the probation and parole office in Menomonie relaying the report that the woman had found what she believed to be child pornography, according to the complaint.

Investigators eventually examined two cellular telephones.

A Samsung Galaxy S3 model contained several videos and about 15,000 image files.

The second phone, an LGVS-700 Enlighten, contained 43 images and two suspect videos.

One of the videos depicts a little girl three to five years old being sodomized by an adult male with a vibrator, according to the complaint.

Initially, bail was set with a $1,000 cash bond for Kastberg December 20, and the defendant was ordered to have no contact with computers or cellular telephones.

During Kastberg’s initial appearance in court on December 23, the cash bond was amended to $25,000.

During the arraignment hearing January 24, the cash bond was amended to $7,500.

Kastberg demanded a speedy trial during the January 24 hearing.

A pre-trial hearing is scheduled in Dunn County Circuit Court March 21.

A one-day jury trial is scheduled April 8.
