HUDSON — The St. Croix County district attorney is waiting for DNA results from the state crime lab related to a stabbing incident on the Apple River in July that left four injured and one dead.
St. Croix County District Attorney Karl Anderson said he was waiting for test results from the state crime lab pertaining to the case against Nicolae Miu, age 52, of Prior Lake, Minnesota, at a court hearing November 1.
Miu appeared with his attorney, Aaron Nelson, before Judge Michael R. Waterman for a status hearing.
Another attorney representing Miu, Corey Chirafisi, appeared at the hearing by Zoom.
Miu is charged with five felonies that include one count of first degree intentional homicide and four counts of attempted first degree intentional homicide. He also is charged with one misdemeanor count of battery. All of the charges include the modifier of use of a dangerous weapon.
District Attorney Anderson said he would like to have another status hearing in the case in 30 to 45 days.
Nelson and Chirafisi both said they had no objection to scheduling another status hearing within the timeframe District Attorney Anderson anticipated.
The knife that was suspected to be the murder weapon has been sent to the state crime lab for DNA analysis, Anderson said, adding that he was hoping to have the results of the DNA analysis within 30 to 60 days.
Another status hearing for Miu is scheduled in St. Croix County Circuit Court December 13.
At the time of the November 1 hearing, Miu remained in custody at the St. Croix County jail.
Bail was set at $1 million cash for Miu on August 1.
First degree intentional homicide and attempted first degree intentional homicide are Class A felonies that, upon conviction, carry a mandatory sentence of life in prison.
Battery is a Class A misdemeanor that carries a penalty, upon conviction, of a fine of up to $10,000 and/or up to nine months in jail.
Miu is charged in connection with allegedly attacking five people with a knife on the Apple River in the Town of Somerset about 3:45 p.m. Saturday, July 30.
A 17-year-old male from Stillwater was pronounced dead after being transported to Lakeview Hospital in Stillwater. Two of the victims were flown to Regions Hospital in St. Paul, and two were taken by ambulance to Regions Hospital, according to a news release from the St. Croix County Sheriff’s Department.
In addition to the 17-year-old, the victims included a 20-year-old man from Luck, a 22-year-old man from Luck, a 24-year-old woman from Burnsville, Minnesota, and a 22-year-old man from Elk River, Minnesota.
