MENOMONIE — A 40-year-old River Falls man convicted by a Dunn County jury has been sentenced to 25 years in prison for the first degree sexual assault of a child in Boyceville.
Derek P. Johnson, along with his attorney Daniel P. Repka, appeared before Judge James Peterson in Dunn County Circuit Court for a sentencing hearing on July 9.
Johnson was found guilty following a three-day trial at the end of January on one felony count of the first degree sexual assault of a child under the age of 12 with the modifier of being a repeat offender.
In addition to 25 years of initial confinement in prison, Judge Peterson also sentenced Johnson to 10 years of extended supervision, according to on-line court records.
The court ordered Johnson not to consume, use, possess or purchase any alcohol and/or illegal, illicit, mood-altering drugs and to only take prescription medication in the amount prescribed by a treating physician.
Johnson also was ordered not to enter any establishment where the primary purpose is the sale of alcohol (bars, taverns, liquor stores or beer tents), to have no contact with the victim, to have no contact with anyone under the age of 18, to comply with the Wisconsin Sex Offender Registry Program, to pay court costs of $518 and to pay restitution, if restitution is ordered, as well as paying supervision fees.
Judge Peterson granted Johnson credit for 191 days served in jail.
Boyceville
According to the criminal complaint, the sexual assault took place in the Village of Boyceville a number of years ago.
The criminal complaint in the case was filed in November of 2021.
During a forensic interview with a Dunn County social worker, when asked to tell the social worker about Johnson and what had happened, the girl brought her knees to her chest and began crying.
Boyceville Police Chief Greg Lamkin, who received a report a couple of months earlier about the sexual assault of a child several years ago in Boyceville, observed the interview remotely.
Police Chief Lamkin said he viewed the girl’s act of bringing her knees to her chest “as a protective posture,” the complaint states.
When the social worker asked the girl if Johnson had said anything to her, the girl said he had told her that if she told anyone, he would do the same thing to her younger sister, who was two or three years old at the time, according to the complaint.
The first degree sexual assault of a child is a Class B felony that carries a penalty of up to 60 years in prison.
