MENOMONIE — A 36-year-old Boyceville man has pleaded guilty in Dunn County Circuit Court to four felony counts related to the sexual assault of a child while 16 other felony counts were dismissed but will be read into the record for sentencing.
Mitchell D. Miner appeared before Judge Rod Smeltzer for a plea hearing January 31.
Judge Smeltzer accepted Miner’s pleas of no contest and found the defendant guilty of four felony counts of the repeated sexual assault of the same child with at least three violations of first degree sexual assault.
All together, Miner was charged with 12 Class C felonies, including second degree sexual assault of a child, and eight Class B felonies, including repeated sexual assault of the same child and first degree child sexual assault involving intercourse with a child under the age of 12.
According to the criminal complaint, one of the victims said the sexual assaults had started nearly ten years ago, and the other victim said the sexual assaults had happened too many times to count.
Judge Smeltzer ordered a pre-sentence investigation.
A sentencing hearing is scheduled at 3 p.m. April 23.
Miner remains in custody at the Dunn County jail on a $200,000 cash bail.
A Class B felony carries a penalty, upon conviction, of a prison sentence of up to 60 years on each count.
A Class C felony carries a penalty, upon conviction, of a fine not more than $100,000 and/or a prison sentence of up to 40 years on each count.
