Packing the court!
A new election campaign question has come to the front of the Presidential race, with the question about the Democratic party’s quest to add more members to the United States Supreme Court.
At question is the fact that President Trump’s selection of Amy Coney Barrett is faced with much opposition from the Democrats on Capitol Hill not because of her ability, but it’s another Trump appointment, his third.
Those Democrats are afraid that Barrett will swing the court into the more conservative agenda and stop the liberal march to change the way we are governed.
Presidential candidate Joe Biden has been questioned several times about packing the court, which means that he could, with the help of congress, add more members to the court and maintain the liberal leaning thinking of the court.
Franklin Roosevelt attempted to pack the court back in the 1930s, but he could not. Back in 1983, then Senator Biden suggested that it was a bad idea to attempt to pack the court.
But now, Biden will not tell us voters his position on packing the court and avoids the question. We need to know how he stands on this issue.
The Constitution does not state how many justices should be on the Supreme Court, and there have been nine members for the past century and a half. The Constitution only states that the President has the power, by and with the Advice and Consent of the Senate to appoint Judges of the Supreme Court.
So, here is what I see happening. Barrett will get approved by the senate and take her seat on the Supreme Court before the end of the year. If Trump is re-elected, we will not her any more about packing the court for at least four years.
But, if Biden wins the White House, and he feels the court does not see things his way, or the Democratic Party’s way, he will move to add, two or maybe four more members to the Supreme Court so that he can change our country into a Socialist state. If you are wondering what the Socialist theory is, I looked it up in my Oxford American Dictionary for this explanation. “A political and economic theory that holds that a country’s land, transportation, natural resources, and chief industries should be owned or controlled by the community as a whole.”
If Biden packs the court, then when and if the Republicans regain control of the government, then they will add two or four more justice to the Supreme Court and so one until we have another branch of the government that will make laws for us to endure. If we look back and see how inferior courts have made laws that did not come from congress and did not pass over the Presidents desk for his signature.
Biden has to tell us what his plans are, and we need to know that and how he feels about adding more states to the union,
If you watched the Vice Presidential debate last week you heard Biden’s running mate, Senator Kamala Harris claim that President Lincoln in 1864 chose not to nominate a Supreme Court Justice until after the election because he wanted the people to vote.
There is no evidence that Lincoln ever said that or that his reason for delaying a Supreme Court nomination had anything to do with the election.
Chief Justice Roger Taney died on October 12, 1864 at the age of 87, just 27 days before the presidential election and Lincoln did not make a nomination to replace him until December, after the election, which he won.
One reason I heard was that congress was not in session in October and was not scheduled to come back to Washington until December. Today a special session of Congress could be called and all members could catch a plane and be back to work within 24-hours. But back in 1864, there were no planes and the transcontinental railroad was not completed until May of 1869, so how long would it have taken a senator from California to get to Washington D.C?
But there is no evidence that was the reason either, but it makes a good story.
