With the passing of Supreme Court Justice, Ruth Bader Ginsburg, the fight in the United States Senate is about to get underway. If you think the battle two years ago when President Trump nominated Brent Kavanaugh was a circus, just wait until next week after the President makes his choice to replace Ginsburg known.
Ginsburg was nominated by former President Bill Clinton and took the seat on the Supreme Court on August 10, 1993. According to the Constitution, the president alone had the responsible to nominate a candidate for the Supreme Court. Under Article two, Section two, the Constitution states; “He (the president) shall nominate, and by and with the Advise and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the Supreme Court.
If you remember two years ago charges of inappropriate sexual conduct were brought against Kavanaugh by the party that was not in power and opposed to his being placed on the court.
I feel that whoever the president nominates this week, man or woman, will face an uphill battle in the senate to win the support of that body. He or she will face many charges; some I know will not be true, but will leave a stain on the nominee. Many want the president to wait until after the November election. Most of those people are Democrats that are banking on Biden winning the election and then he will nominate a party puppet that will support their left-wing socialist program for America.
Ginsburg died last Friday from pancreatic cancer at the age of 87 and it was reported that she had dictated a statement to her granddaughter that said; “My most fervent wish is that I will not be replaced until a new president is installed.” When the president discussed that statement Monday morning he stated: “I don’t know that she said that, or was that written by Adam Schiff or Pelosi?”
Robert Romano of the Americans for Limited government put it this way. “The stage is already set for President Donald Trump to nominate the replacement for the late Ruth Bader Ginsburg to the Supreme Court, even though it is an election year. Former President Barack Obama set that precedent in 2016. In February, 2016, when Antonin Scalia passed away, Obama nominated Merrick Garland to replace him, stating, ‘I have fulfilled my constitution duty. Now it’s time for the Senate to do theirs.’ Presidents do not stop working in the final year of their term. Obama went on alot about how his nominee deserved a vote. Garland never got one as Senate Republicans exercised their own constitutional prerogative to reject him. When you are in power, you take the chance that you have to reshape the country. Make no mistake; if Democrats had maintained a Senate majority in 2014, they would have easily confirmed Garland in 2016. But, they lost nine seats, and elections have consequences. Just like in 2016, voters of each party today will expect their leaders to press their advantage. Dynasties are not built by generosity to one’s adversaries. Democrats will beg for mercy, but President Trump and Senate Majority Leader Mitch McConnell know that in 2016, Obama did not think twice about attempting to flip the nation’s high court even without a Senate majority. That was the only precedent that matters.”
So brace yourself for the nightly battle on TV news over the nomination process, and may the best man (or woman) win.
