Boyceville woman bound over for trial on drug charges

MENOMONIE — A 44-year-old Boyceville woman facing felony charges of possession of methamphetamine and possession with the intent to deliver as well as felony bail jumping has been bound over for trial.

Brenda L. Herdahl waived the preliminary hearing on the felony charges scheduled before Judge Rod Smeltzer June 5.

During a preliminary hearing, witnesses give testimony, and the judge then uses that testimony to base his or her decision on whether there is probable cause that a crime was committed.

When a defendant waives the preliminary hearing, the judge uses the criminal complaint to determine probable cause.

Judge Smeltzer accepted Herdahl’s waiver of the preliminary hearing as voluntary, found probable cause and bound Herdahl over for trial. She is scheduled to be arraigned in Dunn County Circuit Court June 19.

All together, Herdahl is facing multiple drug-related counts that are included in four different cases.

Herdahl initially was charged with felony possession with intent to deliver methamphetamine and two misdemeanor counts of possessing drug paraphernalia connected with incidents that occurred in the village of Boyceville April 12.

In the next case, Herdahl is charged with felony possession of methamphetamine second and subsequent offense, misdemeanor possession of drug paraphernalia, and felony bail jumping connected with incidents in the Town of Stanton on May 3.

In the third case, Herdahl is charged with felony possession of methamphetamine second and subsequent offense and two counts of felony bail jumping in connection with incidents that occurred in the Town of Hay River May 21.

In the fourth case, Herdahl is charged in connection with a controlled buy of methamphetamine by a confidential informant that occurred in Boyceville April 17.

A small claims eviction case in which Herdahl is named as a defendant also has been reopened.

According to online court records, Judge James Peterson ordered Brenda Herdahl and Chris Herdahl to vacate the premises at  918 Center Street in Boyceville by 5 p.m. April 27.

On May 26, Judge Peterson ordered monetary damages of $3,000 to be paid.
